23/09/2011 (Agence Europe) - Member states cannot prevent programmes broadcast from another member state from being shown on its territory, even if they are of the opinion that their content comes under the heading “incentive to hatred on the grounds of race, sex, religion or nationality” in the sense of the Television without Borders Directive (89/552/EEC). It is up to the member state of origin of the broadcasts to verify whether this is the case and to prevent the programmes from being broadcast if so. However, to the extent that this broadcast is not prevented on its territory, the state of destination of the programmes can prevent the activity on its territory of associations of those responsible for the programmes in question. This was the verdict of the Court of Justice of the EU in the ruling returned on 22 September in two related cases (C-244 and 245/10): the German Federal Administrative Court asked it to interpret the aforementioned directive to find out whether Germany has the right to prevent Kurdish-language programmes being transmitted by satellite by two channels - Roj TV and Mesopotamia Broadcast - from Denmark.
