04/07/2011 (Agence Europe) - No fines for Ciba/BASF and Elementis. On Monday 4 July, the European Commission decided to revoke a decision of 11 November 2009, in which it noted the existence of a cartel in the heat stabilisers market. Ciba/BASF and Elementis will not have to pay fines for their involvement in the cartel. The 2009 decision remains valid insofar as it affects the nine other companies and groups which took part in the cartel. The Commission set fines of a total of €173,860,400. The cartel continued until 2000, but Ciba/BASF and Elementis were involved in it only until 1998. The decision reached by the Commission in 2009, as regard these two businesses, was adopted after the 10-year window for fines to be imposed had expired. (L.C./transl.fl)
