Brussels, 04/01/2011 (Agence Europe) - The Commission suggests amending the regulation on cooperation between member state authorities responsible for ensuring application of European legislation on consumer protection (EC Regulation No 2006/2004), to update it and ensure its effectiveness. The proposal along these lines was adopted on Monday 3 January by written procedure.
The amendment proposed concerns the appendage to the regulation. It aims to update the scope of cross-border cooperation to take into account the changes that have been made in EU legislation on consumer protection. Obsolete provisions are deleted and references to the old legislation are replaced by references to the new.
This is valid for: - directives concerning misleading advertising and comparative advertising (Directive 84/450/EC repealed by Directive 97/55/EC which includes comparative advertising); - the directive on consumer credit (Directive 87/102/EEC repealed by Directive 2008/48/EC on credit contracts for consumers); - the directive on audiovisual media services (89/553/EC repealed by Directive 2010/13/EU, the so-called audiovisual media services directive); - and the directive on the partial time use of real estate (Directive 94/47/EC repealed by Directive 2008/122/EC on consumer protection for certain aspects of user contracts of time share goods, long term holiday products and for resale and exchange contracts).
A correction must also be made to the reference made to Decision 2002/995/EC. It is appropriate to specify that the decision does not modify the directive on abusive clauses in contracts concluded with consumers. (A.N./transl.jl)
