08/12/2010 (Agence Europe) - Commission's court case rejected. In case T-238/08 on which it ruled on 8 November 2010, the European General Court rejected the European Commission's court case calling for the local authority of Valbonne in France to refund some of the money provided in advance by the EU for the research and training contract Valaspi MM 1027 (joint teaching by the towns of Valbonne and Fermo in Italy). The Commission argued that the evaluation report submitted did not meet the terms of the contract and when it learned of the liquidation of project coordinator GEIE ARCHI-MED, it demanded that the money be returned by the local authority of Valbonne, which is jointly liable for the debts contracted by the other parties. The General Court rejected the Commission's arguments stating that, contrary to the Commission's claims, the final report (evaluation report) had been lodged on time, the Commission did not prove that it was reclaiming the right amount of money and that the Commission was late in submitting the argument that Valbonne failed to meet the terms of the contract by failing to submit a breakdown of the project's definitive costs.
