Brussels, 24/08/2010 (Agence Europe) - The European Union delivered an opinion on Tuesday 24 August on a proposal by several member states for a European Investigation Order - a system facilitating the work of justice authorities in obtaining evidence for transnational criminal proceedings (see EUROPE 10197). While recognising the added value of the proposal, the Commission notes the need for clear and detailed rules in full compliance with the EU Charter of Fundamental Rights. The Commission suggests, too, that authorities will be reluctant to use shared evidence such as bank data, phone records or DNA without first having mutual trust in the way it is obtained. It, therefore, reserves the right to make separate proposals, particularly on the obtaining/admissibility of evidence. (B.C./transl.rt)
