Commission proposes reforming way acts of execution are adopted

Brussels, 10/03/2010 (Agence Europe) - Following the entry into force of the Lisbon Treaty, which stipulates that (Article 291) the Council and the European Parliament adopt, by ordinary legislative procedure, a regulation governing the modalities of control by member states for the execution of competencies by the Commission, the latter adopted on Tuesday 9 March, a draft regulation presented by Commissioner Maros Šefèoviè for modifying committee procedures. The acts of execution differ from delegated acts included in Article 290, which establishes a procedure in which the legislator (Parliament and Council) authorise (and which can later revoke this authorisation) the Commission to adopt measures for applying regulation. The modalities governing the way this delegation of competences functions was proposed by the Commission in a communication on 9 December 2009. The acts of execution correspond to decisions hitherto adopted within the framework of management or regulation committees, particularly those regarding agriculture, fisheries, environment, security, health and trade policy. When this reform is concluded, only two procedures are expected to remain: (1) consultation and (2) examination. As the name suggests, the first is exclusively consultative. In the second, the opinion of the committee is, in principle, incumbent on the Commission but the text explains that the Commission could request further discussion in exceptional cases (significant market upsets, security dangers or dangers to individuals or the financial interests of the Union) regardless of committee opposition.
