18/07/2007 (Agence Europe) - The German Federal Court (Bundesgerichtshof) asked the European Court of Justice on Tuesday 17 July to clarify the difference between a delay to and the cancellation of a flight. The passengers of a flight run by the German company Condor (owned by Thomas Cook Plc, UK) have claimed compensation before the German Federal Court in Karlsruhe of 600 euros per person for suffering a delay of 25 hours. It is now up to the European Court to decide whether such a delay should de facto be considered as a cancellation under the meaning of regulation (EC) 261/2004 of the Parliament and Council on the compensation for passengers in the case of cancellation or significant delay of a flight.
