Copyright applies uniformly across EU

Brussels, 20/01/2009 (Agence Europe) - The Court of Justice has ruled that copyright rules applicable in one member state on 1 July 1995 apply also in the others. Therefore, the Court found for the Sony record company, which had taken Falcon Neue Vertrieb GmbH to a German regional court and then the Bundesgerichtshof for distributing Bob Dylan songs recorded before 1966. Falcon argued that there had never been copyright for those songs in Germany, where the marketing at issue had taken place. This argument was rejected: the Court said that in the United Kingdom, copyright lasts 50 years and that this protection applies to the songs in question. Since this legislation was in force on 1 July 1995, directive 2006/116/EC of the Parliament and Council on copyright must be interpreted as giving the same protection to copyright in other member states, including Germany.
