New communication on remedies

Brussels, 23/10/2008 (Agence Europe) - On 22 October 2008, the European Commission unveiled a revised communication on the control of business concentrations in order to provide better information to companies on the best way to answer the Commission's competition concerns. The communication looks at “remedies”, in other words corrective measures to remove potential competition concerns from a planned merger or acquisition. A new “Remedies Notice” has been published to help the companies concerned in a planned merger or acquisition to list the remedies under consideration in terms of market access and sale of businesses. The role of administrators has also been clarified. These innovations are based on changes to regulations (for example, Regulation 139/2004/EC) and take account of the experience of cases like Gaz de France/Suez and Thomson/Reuters, recent case law and the results of a public consultation exercise held in 2001.
