National restrictions on right of free movement must be duly motivated

Brussels, 14/07/2008 (Agence Europe) - On 10 July 2008, the European Court of Justice ruled that member states must not restrict the right of free movement of individuals without carrying out their own analysis of the case in question. It ruled that the Romanian authorities could not prohibit a Romanian, Gheorghe Jipa, from travelling to Belgium simply because he had been deported by the Belgian authorities in 2006 on account of his 'illegal residence' in Belgium (Case C-33/07).
