Brussels, 17/04/2008 (Agence Europe) - Peter Hustinx, European Data Protection Supervisor (EDPS), put forward, on 10 April, possible improvements to the Commission's proposal to amend the directive on privacy and electronic communications. “I welcome the approach followed by the proposal which is in line with views expressed in previous opinions. However, the proposed amendments to the directive are not as ambitious as they should be”, Hustinx states in a press release. The EDPS sets out several proposals to make the most of the review. He first of all considers that the obligation to notify any breach of security should not only apply to providers of public electronic communication services in public networks but also to other actors, especially to providers of information society services which process sensitive personal data (e.g. online banks and insurers, on-line providers on health services, etc). He then recommends adoption of a broader scope for the directive so that it will not only apply to public electronic communication services but also to providers of electronic communication services in mixed (private/public) and private networks. Regarding the right of action against “spammers”, Mr Hustinx considers the new possibility given to legal persons to take action against those who infringe spam provisions should be extended to cover infringement to any provision of the ePrivacy Directive in the electronic communications sector.
