01/02/2008 (Agence Europe) - On 31 January, the Court of Justice announced that it had found against the Grand Duchy of Luxemburg for failing to transpose within the set deadline (31 January 2006) directive 2004/17/EC of 31 May 2004, coordinating procurement procedures in the water, energy, transport and postal services sectors (case C-268/07). The Court highlighted the contradiction between the arguments put forward by the Grand Duchy which, on the one hand, said that existing national legislation already satisfied the requirements of the directive and, on the other, that Luxemburg had already begun the legislative procedure to have the directive transposed.
