Luxembourg, 13/12/2006 (Agence Europe) - On 12 December, the Court returned a ruling stipulating that directive 2003/33/EC on advertising for tobacco products does not infringe article 95 of the EC Treaty. The measures contained in the directive to harmonise provisions in terms of tobacco advertising and sponsorship in the Member States are legal and proportionate, and the case brought by Berlin seeking to have certain of its articles cancelled has been rejected.
