Brussels, 13/01/2005 (Agence Europe) - A decision on public procurement procedure provided for in Directive 2004/17/EC for entities operating in the water, energy, transport and postal services sectors was published by the Commission in the Official Journal L7 of 11 January 2005.
This decision (2005/15/CE) gives detailed rules for application of the procedure provided for in Article 30 of the "special services" directive, which allows the Commission to assess whether an activity is directly exposed to competition. It gives details of the content of the request concerning the applicability of the procedure to be carried out by a contracting authority, a public undertaking or a private undertaking. It also provides for the Commission to publish in the Official Journal C series information concerning the reception of orders, the prolongation of time allowed for a response, and the final decision.
