Brussels, 14/10/2004 (Agence Europe) - The European Commission has decided to send reasoned opinions to France, Germany, Luxembourg and Denmark, which have yet to notify measures transposing Community legislation on roadworthiness tests for vehicles, including checks on speed limiters and exhaust emission levels, into national law. Directive 2003/26/EC concerns technical roadside inspection of the roadworthiness of commercial vehicles and Directive 2003/27/EC adapts to technical progress Directive 96/96/EC on roadworthiness tests for motor vehicles and their trailers. France has failed to communicate the measures transposing Directive 2003/26/EC into its national law. Germany and Luxembourg are in violation of Directive 2003/27/EC. Denmark has failed to communicate transposition measures for either of the Directives, but the deadline for transposing the two directives was 1 January 2004. If there is no satisfactory response to the reasoned opinions within two months the Commission may refer these matters to the Court of Justice.
