Brussels, 05/12/2003 (Agence Europe) - The European Commission is disappointed to see annulled by the European Court of Justice (ECJ) its decision concerning the Volkswagen automobile manufacturer, indicated the spokesperson Tilman Lueder (yesterday's EUROPE, p. 18). The Court ruling will make it very difficult to undertake future prosecutions against automobile manufacturers for unfair trade practices, underlined the spokesperson. In its ruling the Court of Justice argued that the Commission did not prove that there was any 'actual acquiescence' by dealers with Volkswagen proposal to prohibit discounts. The spokesperson underlines that it is extremely difficult to gather proof of this kind of infringement and to push dealers to admit an agreement with a manufacturer. He added that the Commission would make use of all possible appeal procedures against the Court's decision.
