Luxembourg, 24/10/2003 (Agence Europe) - In a press release, the Court of First Instance of the EU notes that it has upheld the European Commission's decision of 1998 against Van den Bergh Foods, formerly HB Ice Cream, a 100%-owned subsidiary of the Unilever group and Ireland's biggest ice-cream maker.
The supply of freezers "free of charge" by Van den Bergh Foods to retailers of ice-cream on the condition that they use them exclusively to store its products is against Community law, indicated the Fifth Chamber of the Court, in an "old" case, as Van den Bergh Foods's case dates back over five years.
