Brussels, 06/08/2002 (Agence Europe) - The European Commission has decided to terminate the formal investigation procedure it initiated to establish whether state aid had been granted to the "Terra Mítica" theme part situated in Benidorm (Spain). The investigation began on 20 June 2001 as a result of a complaint lodged with the Commission by the European Federation of Amusement and Leisure Parks in August 1997. The five points on which the Commission had doubts as to the existence of state aid were as follows: 1) Whether the Spanish authorities financing of the general infrastructure works would benefit the entire community; 2) Whether the value of the assets transferred to Terra Mítica SA by the public company Parque Temático de Alicante SA had been under-valued; 3) Whether the terms of a shareholder's loan granted by the public company Parque Temático de Alicante SA to the private company Terra Mítica SA were acceptable to a private investor operating in a market economy; 4) If a contribution of €36 million to Terra Mítica SA, had been granted by the Valencia tourist agency; 5) The Benidorm local authority granted a tax reduction, which the Commission constituted as state aid and which should have been notified to the Commission in advance but it considered, however, that the aid was compatible with common market rules and concluded therefore, that it was too low to be regarded as State Aid.
