Duff report proposes introducing mechanism to confirm parliamentary immunity

Brussels, 29/05/2002 (Agence Europe) - By 26 to 2 with 3 abstentions, the Constitutional Committee has adopted the report by British Liberal Democrat Andrew Duff proposing to amend the Rules of Procedure of the European Parliament concerning MEP immunity. In order to take account of problems that arose during the transmission of the Spanish request for the lifting of the diplomatic immunity of the MEPs Berlusconi and Dell'Utri, the report recommends mentioning that the request can be addressed by a "competent authority of a Member State" rather than the previous version which noted that the request should come from the "appropriate authority of a Member State". After consulting the Member States, the Legal Committee will draw up an indicative list of the competent national authorities in terms of requesting the lifting of an MEP's immunity. The report also suggests introducing a mechanisms enabling the President, after consulting the Legal Committee President and rapporteur, to take the necessary measures to ensure the respect of the privileges and immunity of an arrested MEP or an MEP subject to measures restricting their freedom of movement when their immunity has not been lifted. On the request of any MEP, the President will inform the relevant Committee to ensure the European Parliament can give its opinion on the confirmation of the MEP's immunity. The report will be voted on by the EP at its June plenary in Strasbourg.
