22/06/2023 (Agence Europe) – On Wednesday 24 May, Belgium’s Data Protection Authority (DPA) declared unlawful and decided to prohibit transfers of personal data belonging to Belgian ‘accidental Americans’ from the Federal Public Finance Service (SPF Finances) to the US Internal Revenue Service under the intergovernmental FATCA agreement (see EUROPE 13107/22). According to the DPA, not all data processing operations comply with the principles of the General Data Protection Regulation (GDPR). The Belgian State has appealed against the decision and an initial hearing has been scheduled for Wednesday 28 June. This appeal has no suspensive effect on the ADP’s decision. The final judgement is expected in the fourth quarter of 2023, and it is possible that the case will be referred back to the Court of Justice of the European Union (CJEU) for further consideration.
