20/07/2018 (Agence Europe) – On Thursday 19 July, the European Commission sent Denmark formal notice to halt its restrictions on the parking of heavy duty vehicles in state owned rest areas that impose a maximum parking period of 25 hours. The Commission considers that this restriction particularly affects foreign hauliers and therefore constitutes nationality-based discrimination. It also adds that this rule does not allow drivers to respect strict EU rules on rest periods for truck drivers. Finally, the Commission considers that it also affects the hauliers' freedom to provide transport services under the terms of Regulation 1072/2009 and constitutes an unjustifiable indirect discrimination. The Danish authorities now have two months to provide observations on this matter. (LT)
