Banco Popular resolution – process to evaluate treatment of former creditors and shareholders begins

13/06/2018 (Agence Europe)On Wednesday 13 June, the Single Resolution Board (SRB) announced that it had received the assessment of the consultancy firm Deloitte on the rescue of the Spanish Banco Popular, to determine whether the creditors and shareholders would have had better treatment if the institution had been liquidated under a normal insolvency procedure. This report marks the start of the consultation process whereby the parties affected may be heard, before the SRB makes its final decision on whether to award compensation. Readers may recall that the resolution decision (see EUROPE 11803) attracted numerous complaints to the European courts from investors who considered that they had suffered harm. The timetable for the various procedural stages is expected to be announced in mid-July, followed by the publication of the draft SRB decision and a non-confidential version of the report. (MF)
