16/01/2017 (Agence Europe) – The Secretariat of the Energy Community sent a reasoned opinion to Ukraine on Thursday 12 January for failing to comply with Directive 2014/52/EU on the assessment of the effects of certain public and private projects on the environment. Ukraine, it is alleged, did not fully transpose the text in the law on environmental impact assessment passed by the Ukrainian parliament on 4 October 2016. The Secretariat of the Energy Community, in its legal assessment, highlights the lack of transposition of the directive’s provisions on transboundary environmental impact assessment and the improper or incomplete transposition of the provisions on the projects to be covered by an environmental impact assessment. Ukraine has two months to react. In the light of the reply or in absence of a reply from Ukraine, the Secretariat may bring the matter to the attention of the ministerial council by way of a reasoned request. (EH)
