12/04/2016 (Agence Europe) - Hungary condemned by European Court of Justice. In a decision (app. 64602/12) made on Tuesday 12 April, the European Court of Justice ruled that Hungary had failed to respect Article 8 on the right of everyone to respect for their "private and family life", as stipulated in the European Convention on Human Rights. This case involves a young Hungarian woman of Roma origin who was subject to insults and threats by participants on an extreme right anti-Roma demonstration in March 2011. The Hungarian authorities failed in their obligation to carry out an enquiry into the specific context and only agreed that there had been "violent harassment”, whilst failing to take any measures required to establish that the motives of the accused were racist. Hungary will have to pay €4000 plus interest for nonmaterial damages and €3717 to cover costs. (JK)
