Brussels, 26/03/2015 (Agence Europe) - The European Commission has decided to refer Belgium to the Court of Justice for its administration's refusal sometimes to recognise mobile workers' documents (Portable Documents A1) certifying that they pay social security in another member state.
The Commission sent a reasoned opinion at the end of September (see EUROPE 11163) to inform the Belgian authorities that they were not complying with Community law in allowing their administration not to recognise Portable Documents A1 and unilaterally to subject workers posted temporarily to Belgium to Belgian social security. Portable Documents A1 certify that these workers pay their social security contributions in the issuing member state and must be recognised by the host member state, which can make use of clearly established procedures to verify the validity of the documents. Belgium, on occasion, decides unilaterally not to recognise them, and thus is in breach of EU law, the Commission says. (Jan Kordys)
