Brussels, 06/05/2011 (Agence Europe) - In a press release issued on Friday 6 May, two Polish Conservative MEPs, Ryszard Legutko and Tomasz Poreba (ECR) called once again for the European Aviation Safety Agency (EASA) to be involved in the investigation into the air crash which cost the lives of Polish President Lech Kaczynski and others in Russia in April of last year (see EUROPE 10116). Making no attempt to conceal their disregard for the current Polish authorities, the two members of the Polish opposition point to the European Commission's recent regulation on investigations into civil aviation accidents (Regulation 996/2010) (see EUROPE 10207). They also refer to the response from the European Commission to their call in March of this year. This stated that European rules require national authorities to include an EASA adviser in investigations into civil aviation incidents or accidents involving a European aircraft in a non-EU country. Several international bodies have already refused to be part of the investigation. According to ICAO, the International Civil Aviation Organisation, civil aviation rules do not apply to this flight since it was a state flight (furthermore the plane belonged to the army and was being flown by military pilots). The Polish military prosecutor in charge of the investigation has not yet come to a final decision on how the flight should be viewed. In its report, the Russian commission of enquiry stated that it was a civil flight. (A.By./transl.rt)
