Proposal on cross-border divorces relaunched

Brussels, 05/01/2010 (Agence Europe) - The commissioner-designate for justice, fundamental rights and citizenship, Viviane Reding, has declared that she supports “fast progress” on the draft regulation applicable to the law on cross-border divorces (Rome III). She provided her answers in a questionnaire devised by MEPs for her hearing by the LIBE, JURI and FEMM committees on 12 January. In a reference to the Swedish veto concerning the proposal, Ms Reding pointed out that all member states had to participate in EU policies: “I am also convinced that the human dimension of this proposal - which could remove substantial legal uncertainty for children and their parents in often conflicting bi-national situations - does not allow us to wait any longer”. If a solution is not forthcoming, the commissioner-designate has said that she is prepared to present a proposal for strengthened cooperation on Rome III in the first few months of her mandate. She stated: “Enhanced cooperation in this matter will send a strong signal to all member states. Of course, I sincerely hope that a sound proposal from the Commission, supported by many member states, would soon attract all member states to join”. Spain has made Rome III a priority under its presidency and is urging the Commission to present a proposal in this connection (EUROPE 10032).
