23/12/2009 (Agence Europe) - On 22 December, the Council adopted a regulation modifying regulation (EC) 881/2002 of the Council which brought in sanctions ("restrictive measures") against certain persons and entities with links to Osama bin Laden, the Al Qaeda network and the Taliban. Further to the ruling returned on 3 September 2008 by the European Court of Justice, this regulation requires modification to bring in a procedure for inclusion on the list, in order to guarantee that fundamental defence rights, particularly the right to be heard, would be observed. The revised procedure provides for the person, entity, organisation or group to be informed of the reasons for their inclusion on the list, in line with the instructions of the United Nations Al Qaeda and Taleban Sanctions Committee, in order to guarantee this party the right to reply to these reasons.
