03/11/2009 (Agence Europe) - On 29 October 2009, the European Commission decided to refer Greece to the European Court of Justice because it has implemented rules on food safety controls which are incompatible, in the Commission's view, with existing Community legislation since they are excessive and discriminatory. EU Regulation 882/2004/EC on official controls harmonises food safety controls within the EU and establishes a risk-based control regime, which enables the authorities of the member states to respond to risks effectively while not impeding trade unnecessarily. In a press release issued on the same day, the Commission points out if the Court of Justice finds Greece guilty, it may have to pay “a lump sum and/or financial penalty” each day until it corrects the rules in question.
