18/01/2008 (Agence Europe) - According to the Court of Justice, a commercial agent should not receive any commission on a transaction in which he/she has played no part (judgment C-19/07 of 17 January). Paul Chevassus-Marche took his employer, the Danone group, to the French appeal court. He was seeking payment of commission on some sales made in the sales area - the islands of Mayotte and La Reunion - to which he had been assigned as sales representative in 1987. The transactions having been carried out directly with central sales offices, without any involvement from Chevassus-Marche, the Court felt that his request could not be based on the directive of 18 December 1986 on the coordination of laws relating to self-employed commercial agents.
