02/03/2007 (Agence Europe) - In accordance with the conclusions of the Advocate General, Ruiz-Jarabo Colomer, the Czech authorities may oblige an ADSL operator in a dominant position to undertake interconnections with its rivals, without the need for a previous market analysis. Telefónica 02 Czech Republic a.s. (formerly Èeský Telecom a.s.), had turned to the European directives 2002/19/EC and 2002/21/EC on communication networks, which state that the “dominant position” must be demonstrated in a market analysis before binding measures are taken, to justify its refusal to open up its network to Czech On Line. However, Mr Colomer ruled that these directives have not been transposed into the national legislation and that, moreover, they were not specific enough to be directly applicable. If the Court follows these conclusions, national jurisdiction will not be obliged to take account of the conditions provided for by the directives in question, and will therefore be free to confirm its previous judgment - which is that the company must provide Czech On Line with the interconnection it has requested (case C-64/06) (cd)
