Commission takes legal action over failure to comply with Birds and Habitats Directives

Brussels, 04/08/2006 (Agence Europe) - The European Commission has taken several decisions on matters concerning application of the Birds and Habitats Directives in the following Member States: 1) Spain: The Commission has closed the case concerning the construction of the Ciudad Real Airport in Spain, after completion of a proper EIA and adoption of effective measures; 2) Greece: first written warning following a judgement of the European Court of Justice against this country on 16 March 2006, for failing to establish and implement a strict protection system for the Milos Viper, an endangered species native to Greece (Case C-518/04); 3) Ireland: final written warning for failure to comply with the Habitats Directive and the lack of proper provision for ensuring that replanting of commercial conifer forests does not adversely affect sensitive species such as the endangered Freshwater Pearl Mussel; 4) Austria: final written warning for not proposing sufficient national nature sites for the EU's Natura 2000 network of protected sites, as set out in the Habitats Directive; 5) France: On this same question of site designation, the Commission states it has not completed examination of the proposals put forward by France (the European Court of Justice said in November 2002 that it had not designated sufficient special protection areas for birds).
