Brussels, 02/08/2005 (Agence Europe) - Arrested in Italy on Sunday, Hamdi Issac, alias Osman Hussain, who admitted having taken part in the attacks in London on 21 July, is opposed to his extradition requested by the United Kingdom via a European arrest warrant. If Italy also wants to take him before the court for belonging to a terrorist organisation, Article 24 of the framework decision establishing the European arrest warrant stipulates that the Italian judiciary authority can decide either to judge him in Italy first of all before transferring him, or transfer him and then request that he is brought back for trial in Italy. The text does not establish an order of priority between the Italian and British judiciary authorities. According to the rules of accelerated extradition procedure, a warrant must be issued in 60 days if the person is opposed to his transfer, with a possible further delay of 30 days. After a German-Syrian national being sought in Spain had been released by the German Supreme Court because the Court considered the German law did not sufficiently protect its citizens against abusive extradition, this is a further test for this procedure, in a matter of terrorism (EUROPE 8993).
