Reasoned opinions for Germany, Finland, Italy and Portugal on conclusion of aviation agreements with third countries

Brussels, 15/12/2004 (Agence Europe) - On Tuesday, the European Commission decided to send reasoned opinions to Germany, Finland, Italy and Portugal on bilateral aviation agreements concluded between these Member States and third countries (respectively Russia; Russia and Thailand; China, Algeria, Singapore and India; Brazil). The Commission, which bases its decision on the 5 November 2002 ruling of the Court of Justice in the "Open Skies" agreements case, takes the view that these agreements infringe European law, as they contain so-called clauses of nationality, which means that they reserve the right of transport to these third countries for their national carriers, to the detriment of other European airlines. Furthermore, these agreements contain provisions on fields which come exclusively under Community jurisdiction, on "slots", tariffs, and booking systems, for example. The Commission, therefore, calls upon these four Member States to remove the illegal aspects of these agreements to come into line with Community law.
