20/08/2003 (Agence Europe) - According to AFP, the governor of the Austrian Tyrol, Herwig van Staa, is envisaging court action against the European Commission for obtaining the provisional suspension of the Austrian decree aimed at banning, on 1 August 2003, all circulation of heavy goods vehicles on a section of the A12 motorway in the Tyrol (Austria). Mr Van Staa is said, no more no less, to be contemplating filing a complaint before the Court of Justice of the European Communities (ECJ) for violation of human rights, as he considers that the health of the populations in the valleys should take preference over the free movement of goods. EUROPE recalls that the ECJ decided to impose the provisional suspension on the basis of a complaint by injunction submitted by the Commission (EUROPE of 31 July, p.3).
