EU worries about human rights violations trial perpetrated in East Timor

Brussels, 07/08/2003 (Agence Europe) - In a declaration made on 6 August by the Italian Presidency on East Timor, the EU welcomed the establishment of an ad hoc Human Rights Tribunal on East Timor for human rights violation committed in East Timor in 1999, with the last verdict being delivered on 5 August. However, the "EU is disappointed that the prosecutors have not submitted all the evidence, especially that referred to by UN investigators and the Indonesian National Commission on Human Rights (KPP-HAM) in their reports, suggesting that elements of the military, police and civil government allegedly funded, trained and abetted local militia groups. Besides, no officials from UNAMET, or members of independent observer missions, and only a very few "victim witnesses" from East Timor, were called to testify by the prosecutors". Since then, the verdicts have been "disproportionate to the seriousness of the crimes committed". And constitute a brake on the reconciliation process. The EU is therefore calling on the Indonesian authorities to ensure that: the appeals process is conducted in a manner consistent with international legal standards; decisions are made in the principle of transparency, UN recommendations on reform of the legal system are implemented; proceedings for the next trials, such as the Tanjung Priok (massacre of Muslim student demonstrators in 1984 in Jakarta by the Indonesia security forces: Editor's note) are improved. The EU deplores the fact that Sanders Theones (a Financial Times journalist killed in 1999: Editor's note) has not been brought to a special court and points out that the killers must be brought to justice without delay and international standards are respected.
