Brussels, 20/09/2002 (Agence Europe) - The spokesman for the European Convention, Nikolaus Meyer-Landrut presented the results of the working group on subsidiarity, chaired by Inigo Mendez de Vigo to the press on Friday, results that will now be forwarded to the Convention. This report takes on board different proposals that the Euro-MP had already presented (see EUROPE of 14 September, p.6). The group also comes down in favour of the creation of an early warning mechanism by which all legislative proposals will be forwarded to national parliaments which will be able, within a period of six weeks, to provide a reasoned opinion should they consider that a proposal infringes the principle of subsidiarity. If a third of national parliaments issue such an opinion, the Commission will have to review its proposal and either maintain it, alter it or withdraw it. The reasoned opinions will thus not be able to impede the pursuit of the legislative procedure, but each parliament to have issued such an opinion will have the possibility of turning to the Court of Justice at the end of the legislative process, if it deems it necessary. Mr. Meyer-Landrut stressed that, in the meantime, changes may have been made to the initial proposal, including the traditional ability of national parliaments to influence the stances adopted by governments within the Council. These changes may also go against the principle of subsidiarity (even if the initial proposal posed no problem) and the working group thus decided to propose that parliaments may also issue a reasoned opinion at the conciliation stage between the European Parliament and the Council. In that case, the procedure would not be affected, but those parliaments that had not issued a reasoned opinion on the initial proposal would have the same right to turn to the Court. The report also proposes granting the Committee of the Regions the right to refer to the Court.
