France proposes compromise on European arrest warrant

Luxembourg, 16/10/2001 (Agence Europe) - The EU15 Justice Ministers began on Tuesday at the end of the afternoon their discussions on the difficult subject of the creation of a European arrest warrant that would replace extradition procedure. They also discussed the adoption of a common definition and common sanctions for terrorism. French Justice Minister Marylise Lebranchu told the press before the opening of work that she planned to present a draft compromise if, as can be expected, the Fifteen did not reach an agreement on a broad vision of the European arrest warrant. "After thinking that it would have to apply for everything, I believe that, in order for an agreement to be reached in December, we must begin with a text that is limited to a positive list of infringements for which the European warrant would replace extradition". The list that France should submit to its partners includes: illegal trafficking of narcotics, fraud against the financial interests of the Communities, money laundering, counterfeiting, the trade in human beings, sexual exploitation of children, child pornography, terrorism, organised crime, murder, and armed theft and rape. "This would be a first stage, and we shall have to come back to the question", added the minister. Still before the meeting, British sources said they were "shoulder to shoulder" with the Commission concerning the scope and dual incrimination. Spain shares this position but opinions are nonetheless very divided, many countries being reticent about a broad vision of the warrant, and especially given the abandonment of the principle of dual incrimination. Germany, for example, states it is in favour of broad application while keeping the possibility of demanding that the infringement in question also be sanctioned in the State to which the request is made.
