Commission may not oppose access to written submissions of member states held by it on sole grounds that they relate to court proceedings

On Tuesday 18 July, the Court of Justice of the European Union (CJEU) upheld a judgment of the General Court of the European Union (case C-213/15 P), in which the judges found that an application for access to written submissions of the member state should be dealt with on the basis of Regulation 1049/2001 on public access to documents held by the European Parliament, the Council and the European Commission.
