Brussels, 28/04/2016 (Agence Europe) - On Thursday 28 April, the Commission decided to bring proceedings against Spain before the European Court of Justice for its failure to comply with the judgement of December 2014 (case C-576/13) condemning it for not observing freedom of establishment in Spanish ports.
In 2014, the Court found that the obligation for goods handling services operating in Spanish ports to register with a management company (SAGEP), to hold shares in that company and to employ as a priority workers provided by that company ran counter to article 49 of the Treaty on the Functioning of the EU (TFEU) as regards the freedom of establishment.
Despite this judgement, Spain has still not adequately addressed the problems identified by the Court, although it had until February 2015 to inform the Commission of the measures taken to comply with the judgement. The European Commission therefore calls on Spain quickly to make the necessary reforms to comply with the 2014 judgement. Should it failed to do so, the Court may decide to fine it.
