Risk of committing war crimes should allow soldiers to seek EU asylum

Brussels, 13/11/2014 (Agence Europe) - Non-combat military personnel may claim asylum if they consider themselves to be at risk of prosecution or punishment for refusal to perform military service where so doing might involve commission of war crimes.

Thus concluded Advocate General Eleanor Sharpston on Tuesday 11 November in a case (C-472/13) involving an American soldier who deserted and sought asylum in Germany.
