CAP reform - new implementing act

Brussels, 31/07/2014 (Agence Europe) - On Thursday 31 July, the European Commission published (in the Official Journal of the EU) Implementing Regulation 809/2014 establishing the details for the application of Regulation 1306/2013 regarding the integrated administration and control system (IACS), measures in favour of rural development and cross-compliance. This comes on top of the publication, on 20 June, of the implementing act and delegated acts related to direct payments, plus one delegated act on the IACS and the conditions for the withdrawal of payments and administrative sanctions applicable to direct payments, amongst other things.

Regulation 1306/2013 of 17 December 2013 concerns the funding, management and monitoring of the common agriculture policy (cross-cutting regulation).

The implementing regulation lays down the details for the application of Regulation 1306/2030 as regards, amongst other things: - the notifications to be made by the member states to the Commission, in line with their obligation to protect the financial interests of the EU; - administrative checks and checks on the ground to be carried out by the member states in order to verify that the eligibility criteria are being adhered to; - the minimum level of controls on the ground; - the recovery of undue payments and penalties due; - the application and calculation of administrative sanctions; - aid applications and payment claims and applications for payment entitlements (final date for the submission of applications); - the transfer of holdings; - the payment of advances; - the carrying out of checks relating to cross-compliance obligations, including taking account of the farmer's participation in the farm advisory system or a farmer's participation in the certification system; - the calculation and application of administrative penalties in respect of cross-compliance obligations.

With this publication, all of the rules on the direct payment regimes, including those covering administration and checks, are now available to the member states and to farmers. The member states now have all of the detailed elements they need to implement the direct payments plank of the reform of the common agriculture policy (CAP), at national or regional levels, with effect from 1 January 2015.
