Legal basis for cross-border enforcement revised

Brussels, 22/07/2014 (Agence Europe) - On Friday 18 July, as requested in a European Court Justice ruling last May, the European Commission published a revision to the directive on cross-border enforcement of infringements to the highway code. The Court ruled that the legal basis for this European legislation to strengthen road safety was biased and based on police cooperation rather than transport policy. The Court, however, decided that the directive should remain in application until May 2015, so that the Commission had time to amend its legal basis.

This has now been done with an amendment exclusively made on the form rather than the substance of the legislation. Although the substance of the legislation has not been changed, the European Parliament and Council will still have to adopt this revision. With a proposal published in July, the Commission has left these two European institutions enough time to decide on the matter. The executive director of the European Council for transport safety, Antonio Avenoso, stressed that the go-ahead needed to be given as soon as possible. (MD)
