New VAT rules for electronic services

Brussels, 16/10/2012 (Agence Europe) - On 9 October, the ECOFIN Council adopted without debate a regulation on application of provisions in the EU VAT Directive 2006/112/EU concerning special schemes for non-established taxable persons supplying telecoms, broadcasting and electronics services to people not registered for VAT within the EU. The regulation will come into force on 15 January 2015 and will alter EU Regulation 282/2011 of 15 March 2011, laying down new rules for special schemes for suppliers registered for VAT in another member state from their customer or outside the EU.

The regulation makes such suppliers liable for the rule of VAT being charged in the country of the consumer, as laid down in the VAT Directive. Hence the regulation establishes an EU system whereby suppliers in other member states from their customers or suppliers outside the EU must electronically identify themselves to a member state as being subject to VAT and must lodge VAT returns with said country.
