Meaning of “communication to public” and obligation to pay royalties

Brussels, 15/03/2012 (Agence Europe) - A hotel operator, which broadcasts phonograms in its rooms, should pay equitable remuneration to producers and member states may not exempt such operators from this obligation. However, a dentist who broadcasts phonograms free in his private practice as ambient music is not subject to this obligation, insofar as he is not carrying out a “communication to the public” within the meaning of EU law.
