13/10/2010 (Agence Europe) - Switzerland has lodged an appeal with the Court of Justice of the EU in the hope of overturning flight restrictions imposed by Germany on the international airport of Zurich, the minister for the environment and transport announced on Wednesday 13 October. In June 2003, Switzerland brought a complaint to the European Commission about flight restrictions imposed by Germany on Zurich Airport. Even though Zurich Airport is on Swiss territory, part of its approach is from the south of Germany. These flight paths over German territory were restricted seven years ago, in order to reduce noise pollution for the airport's neighbours on the German side. The Swiss complaint was rejected in December 2003 by the Commission and an appeal against that decision was thrown out by the Court of the EU on 9 September. By bringing the case before the Court of Justice of the EU, Switzerland is using up its final appeal. According to Berne, the airline Swiss, a subsidiary of Germany's Lufthansa, “is a victim of indirect discrimination”. (L.C./transl.fl)
