05/08/2010 (Agence Europe) - With its ruling of 29 July in Case C-35/10, the EU Court of Justice found France guilty of not having implemented the legislative, regulatory and administrative provisions necessary within the time given for coming into line with Directive 2006/21/EC on the management of waste from the extracting industry. The directive in question provides for extracting waste to be managed in specialised installations complying with specific public health and environment protection standards and based on the “best available techniques”. Member states must also ensure that the operator of that installation sets out a plan for waste management, to be reviewed every five years. The Commission opened infringement proceedings against France in 2008. (F.G./transl.jl)
