10/06/2016 (Agence Europe) - General Court annuls anti-dumping duty on American bioethanol. In a ruling delivered on Thursday 9 June (case T-276/13), the General Court of the EU annulled the regulation putting in place a definitive anti-dumping duty on imports of bioethanol from the United States for use as fuel. The regulation, which has been in force since February 2013 (see EUROPE 10792), was successfully challenged by the companies Patriot Renewable Fuels, Plymouth Energy Company, POET and Platinum Ethanol. The Court found in their favour on the grounds that the EU regulation at issue put in place a country-wide duty so far as the four sampled US producers are concerned. The EU should have stated the anti-dumping duties to be paid by each supplier. An appeal against this ruling may be lodged within two months. (JK)
