Court confirms liability of air transporters in cases involving loss, damage or delay of luggage - Compensation will be limited to €1,134.71 per passenger

Brussels, 03/05/2010 (Agence Europe) - The European Court of Justice (ECJ) made a decision on Thursday 6 May in case C 63/09 involving the extent of liability of air transporters for the destruction, damage, delay or other problems of this nature. The ECJ confirmed that the liability of air transporters in this domain is limited to €1,134.71 per passenger and considers that this amount, stipulated by the Montréal Convention (see below) is the absolute limit covering “moral and material...
