The European Court of Human Rights issued a judgment on Thursday 25 March which for the first time condemned a State for the execution of a European Arrest Warrant (EAW). The case concerns Mr Moldovan, who was handed over by France to Romania, despite the fact that he had lodged an appeal (rejected) with the Court of Cassation and had provided sufficient evidence of the risks of degrading detention conditions that he faced.
